Terms of sale

1. Seller's identity and contact details

These terms of sale are offered by SARL SELLERIE CASSOU, a French limited liability company with share capital of 15,244.90 euros, whose registered office is at 75 rue des Pyrénées, 64800 Bénéjacq, France, registered with the Pau Trade and Companies Register under number 390 710 432.

EU VAT number: FR89390710432.

For any question about an order or after-sales service:

Telephone: +33 (0)5 59 61 11 25.
Postal and returns address: Sellerie Cassou, 75 rue des Pyrénées, 64800 Bénéjacq, France.

The online shop uses the Shopify platform. Sellerie Cassou remains the seller and the customer's point of contact for performance of the sale.

2. Scope

These terms govern purchases of goods made through the online shop by consumers for purposes outside their trade or profession.

Sales to business customers and repair or restoration services are subject, as applicable, to separate terms or a separate quotation. Nothing in this text deprives a customer of any mandatory legal protection to which they are entitled.

The customer must have the legal capacity required to place an order. The applicable terms are those provided to the customer and accepted when the order is placed. Subsequent changes do not apply retrospectively to sales already concluded.

3. Products and pre-purchase information

The essential characteristics of each product are set out on its product page: use, materials, dimensions, options and other relevant information depending on the model.

The customer checks the options selected, including size, material, colour and, for certain saddles, weight. If uncertain about the suitability or use of equipment, the customer is invited to contact the workshop before ordering.

Photographs illustrate the products. Screens may produce limited differences in colour rendering; this does not entitle the seller to deliver a product that does not match the agreed characteristics. Natural variations in leather and handcrafted production do not affect statutory guarantees.

4. Made-to-order products and personalisation

Some products may be ordered even when they are not immediately available, particularly where they are made to order. Being able to add an item to the basket therefore does not necessarily mean that it is ready to dispatch.

The applicable delivery period, including manufacturing and preparation, is communicated before the order is confirmed. For requests requiring a quotation, the specifications, price and time frame are agreed before the customer commits.

Requests for embroidery, initials, specific dimensions or special finishes are subject to the workshop confirming feasibility. An order note alone does not constitute acceptance of a technical modification or an additional service. Any change to the price or time frame requires the customer's express agreement.

Making an item to order does not automatically exclude the right of withdrawal. The exception for goods made to the consumer's specifications or clearly personalised is explained in section 10.

5. Prices, currencies and taxes

Prices and the billing currency are shown in the shop and in the summary before payment. For delivery in France, consumer prices include applicable VAT.

Delivery charges and any other charges are specified before the order is confirmed. The customer pays no additional charge that has not been disclosed and accepted.

Depending on the delivery country and available markets, the display currency and tax treatment may vary. The amount charged is the amount shown in the order summary. The customer's bank may apply its own foreign exchange charges, independently of the seller.

Imports may be subject to additional customs duties and local taxes. The checkout specifies amounts collected by the seller and, where applicable, amounts remaining payable on import. Sellerie Cassou does not charge again for taxes it has already collected for the same transaction.

6. Ordering and confirmation

The customer selects products and options, adds them to the basket and provides the information needed for billing and delivery.

Before confirming the order, the customer can check its contents, correct errors and review the total price, delivery method, stated time frames and these terms.

Final confirmation is made using a button clearly indicating that the order entails an obligation to pay. The customer receives an email confirmation with an order number and a summary of the agreed details.

The customer ensures that their contact details are accurate and promptly contacts Sellerie Cassou if an error is found. Corrections after dispatch are handled according to what the carrier can actually do, without charging unjustified costs.

In the event of a fraudulent order or an objective difficulty preventing fulfilment, the seller informs the customer and applies the legal rules on cancellation and refunds. No substitute product or additional charge may be imposed without the customer's agreement.

7. Payment and invoice

Available payment methods are those offered at checkout. Payment is due when the order is placed, unless different arrangements have been expressly agreed, particularly in a quotation.

Payments are processed by the providers offered through the shop. If instalment payments are available, their terms, any costs and eligibility criteria are presented before the customer enters into them.

An invoice is supplied or made available to the customer on a durable medium. The order may be suspended if payment is declined or fails; the customer is informed.

8. Delivery, delays and unavailability

Available destinations and delivery methods depend on the countries served and the parcel's characteristics. Charges and the delivery date or time frame are communicated before the order is confirmed.

Where a product is made to order, the stated time frame includes manufacturing. If no date or time frame has been agreed, delivery takes place without undue delay and no later than thirty days after the contract is concluded.

In the event of delay, the customer may require the seller to deliver within a reasonable additional period, then terminate the contract if delivery does not take place within that period. Immediate termination is possible in the circumstances provided by law, including refusal to deliver or where the date was an essential condition of the contract.

Where the contract is terminated in these circumstances, amounts paid are refunded within fourteen days of termination, without prejudice to the consumer's other rights.

If unavailability prevents fulfilment, Sellerie Cassou informs the customer and, with their agreement, offers a revised time frame or an appropriate solution. If no agreement is reached, the affected order is cancelled and refunded in accordance with applicable rules. A credit note is not imposed.

9. Receipt and transport risks

Where delivery is entrusted to a carrier offered by Sellerie Cassou, the risk of loss or damage passes to the customer when the customer, or a third party designated by them other than the carrier, takes physical possession of the goods.

Where the customer appoints a carrier independently, other than those offered by the seller, the specific statutory rules on transfer of risk apply.

The customer is invited to check the parcel on receipt and promptly report any problem to Sellerie Cassou, with photographs if possible. The customer may record specific reservations with the carrier or refuse a visibly damaged parcel.

Failure to record reservations or refuse the parcel does not remove the customer's rights against the seller, including statutory guarantees. No general ten-day claims deadline limits those rights.

10. Withdrawal, returns and refunds

Non-personalised products

The consumer has a statutory period of fourteen days from receipt of the goods to notify withdrawal, without having to give reasons. Where several goods are ordered together and delivered separately, the period runs from receipt of the last item, in accordance with applicable law.

The consumer may notify their decision by an unequivocal statement sent by email or post to the contact details in section 1, or use the form in the appendix. Use of the form is not compulsory. Keeping proof of sending is recommended.

The consumer may also use the free online withdrawal function available at [location and link to be completed after implementation and testing]. Confirmation of the request is sent on a durable medium. This option does not replace other lawful notification methods.

The customer then returns the goods no later than fourteen days after notifying withdrawal. Direct return costs are borne by the customer, unless the seller made an error, the goods do not conform or more favourable terms were announced before the sale.

The product must be returned complete, with its accessories and, if possible, its original packaging. Absence of that packaging alone does not exclude withdrawal. The customer may be liable for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Sellerie Cassou refunds the amounts due, including the initial standard delivery charges where withdrawal concerns the entire order, no later than fourteen days after being informed of the customer's decision. For sales of goods, the refund may be withheld until the goods are recovered or proof of dispatch is received, whichever occurs first.

The supplement for expressly choosing delivery more expensive than the standard delivery offered is not refunded. The same payment method is used for the refund unless the customer expressly agrees to another method, at no cost to them.

Exception for clearly personalised goods

Under Article L. 221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised, such as an item embroidered with their initials or made to their own measurements.

The customer is informed of this exception before ordering the relevant goods. Merely choosing from standard catalogue sizes, weights or colours is not sufficient to justify systematically excluding withdrawal. Statutory guarantees continue to apply to personalised products.

Exchanges

Exchange requests may be considered with the workshop depending on the products and availability. Arrangements and any charges are specified before agreement. This option neither replaces nor reduces the right of withdrawal or statutory guarantees.

11. Statutory guarantees

Sellerie Cassou is liable for lack of conformity under Articles L. 217-3 et seq. of the French Consumer Code and for hidden defects under Articles 1641 et seq. of the French Civil Code.

For new goods, consumers benefit from a two-year statutory guarantee of conformity from delivery. Remedies, periods and conditions are those provided by law. The seller remains the consumer's point of contact and cannot require them to deal exclusively with the manufacturer.

Normal wear and damage resulting from unsuitable use do not, in themselves, constitute a lack of conformity. They cannot, however, be used to exclude a defect covered by a statutory guarantee.

[BEFORE PUBLICATION: insert here, in a box, the current regulatory model A for goods from the appendix to Article D. 211-2 of the French Consumer Code. This summary does not replace it.]

12. Liability and use of equipment

The customer uses equipment in accordance with its intended purpose, stated characteristics and care instructions. If unsure about the condition of equipment or its suitability for a use, the customer stops using it and seeks advice from the workshop or a competent professional.

Sellerie Cassou remains responsible for proper performance of its obligations under the law. These terms do not limit mandatory liabilities, statutory guarantees or the consumer's rights to redress.

A stock shortage, supply difficulty or transport incident does not automatically constitute force majeure. Only events meeting the legal conditions may be relied upon as such.

13. Personal data

Data needed for ordering, payment, delivery and after-sales service are processed for the purposes and on the legal bases described in the shop's privacy policy.

Acceptance of these terms does not constitute consent to marketing communications or non-essential cookies. The relevant choices are collected separately where required by law.

14. Complaints and mediation

For complaints, the customer first contacts Sellerie Cassou using the details in section 1 and provides the information needed to assess the request.

After a prior written complaint that has not led to a satisfactory solution, the consumer may refer the matter free of charge to the consumer mediator appointed for Sellerie Cassou, subject to statutory admissibility conditions:

Consumer mediator: currently being researched. Contact details will be added once a mediator has been appointed.

Mediation does not prevent the consumer from bringing court proceedings.

15. Applicable law and jurisdiction

These terms are governed by French law. This choice does not deprive a consumer resident in another country of the mandatory consumer protections applicable to them.

In a dispute, jurisdiction is determined by the applicable rules. No exclusive jurisdiction of the Pau courts is imposed on consumers.

If a provision is held inapplicable, the remaining provisions continue to have effect to the extent permitted by law.
